Entry into the United States. For entry into the U.S. must first answer the following questions:
- Purpose of trip The purpose of the trip may be vacation as a tourist or a business trip. For both types of travel are different things to consider before the departure. The simplest case is:
- Vacation or tourist stay in the United States, According to an agreement between the Federal Republic of Germany and the United States you need no visa for such a visit. For this visit a machine-readable, burgundy-colored passport is required. The expiration date of this passport must be at least a few months longer than the end of your visit. This machine readable passport is also necessary for young people and accompanying children under 18 years. The currently existing child passes are no longer accepted by the U.S. authorities. Furthermore children’s passport which is issued before the 26th of October 2006 can be used for the entry without a visa. If the children’s pass port is issued on the 26th of October 2006 or later this passport is not allowed for a trip without a visa. In this case a new passport must be ordered for the child or a visa must be applied. The passport which was issued before the 26th of October 2006 did not contain biometric data of the passport holder. For this reason the authorities take the biometric data since October 2004 by themselves when you are entering the United States at the passport control. This procedure is simple and takes only time depending on the technical equipment and the number of the arriving people. Each traveler must comply the fingerprinting of both index fingers and allow a digital photograph of the face at the border control. These biometric data are only temporarily stored so that this procedure is redone each time when you enter the country. Passports which are issued since 26th of October 2006 have already the requisite biometric data available so this entry procedure will be modified.
For business travelers is important to know that doing business without a
visa is only possible in a very limited perception. In this case the above remarks about the passport are the same but you also need a tourist visa which has to be catch at the American foreign authorities before starting the trip. The visa procedure can be time consuming and costs 108 Euro per person in Germany (July 2009). With this visa is also strictly prohibited to work in the United States and a breach of this rule may ban you for future entries. Since December 2007 two fingerprints are no longer enough. If you apply for a visa you have to give prints from all 10 fingers. On the day of the fingerprinting in the consulate your finger should have no injuries such as cuts or blisters because these would distort fingerprints.
This rule is designed to prevent people from getting a visa although they
have a criminal record. For doing business in the United States it is irrelevant how long the stay in the United States will be. If you want to do business in the United States you must request for an appropriate visa at the American foreign authorities in your home country and you must get the visa before you start your trip. What type of visa for which business approach is required can be clarified either by a lawyer or directly with the embassy. After clarifying the purpose and length of stay there are more tasks to do before the entry into the country: Every airline which offers flights from Europe to the United States are legally forced since October 2005 to send special information about their passages to the United States authorities before the departure. This data transmission is necessary for all people who travel as tourist and have no long stay permission like green card etc. The procedure for the data transmission has changed since the 12th of January 2009: Foreign people who enter the United States without a visa must fill out an ESTA-Application in their home country at least 72 hours before their departure. Such an application is mandatory for each individual visitor, inclusive children with or without accompanying persons. In this application the visitor has to provide all the data which are asked in the I-94 entry document in advance. Detailed travel plans inside the United States are till today not necessary. The provided data of the application are checked with the existing US-criminal record database. As a result the applicant gets the following responds from the system: Authorization approved, Authorization not approved, Authorization pending. The positive Answer of the ESTA-Systems allows the entry for several times into the United States and is valid for 2 years or till the passport expired, depends on which events happens first. The positive system respond is an approval that the entry without a visa matches with the existing rules of the Visa Waiver Program. If the respond of the system is negative this means that the entry under the conditions of the Visa Waiver Program is not possible and an immediate deportation to the home country may happen at the border. The newest information show that you also must have an ESTA-Approval even if you have a US-Visa. If you did not apply for this approval you are mostly allowed to enter the country but the office at the border reminds you nicely to apply for this approval before you make your trip the next time. Therefore the airlines will insist on a positive respond of the ESTA-system and will only perform transportation in this case. In the other case the airline will be responsible for the return transportation to the home country of the denied passenger. A positive answer from the ESTA-system is not legal claim for the entry into the United States. That means that the officer at the border must allow the visitor the trespassing of the border line. While packing the baggage you should not put pointed and sharp objects like nail scissors into your hand baggage. When checking in the baggage is scanned and all unauthorized items will be confiscated and destroyed. During the flight there are green-entry applications and declarations which are handed out by the flight attendants. On the green applications you have to fill in your personal information such as name, first name, sex and date of birth, legal anomalies such as drug offenses and diseases, flight number and first contact address in the United States. The American authorities are very accurate with the proper filling of their documents. So is the number “1” must be written without the upper hook comparable to the Roman number “I” and the number “7” has no dash in the middle. This information is often given during a movie in the aircraft. If you need help ask the flight attendants.
